ReplyI question the emanate domain route, only because it is an unusual circumstance. If you use emanate domain what do you take? Is the government going to take the home also?
In most emanate domain cases the home/property is taken and you are compensated based on a fair market value. In this case emanate domain would apply to, and I am assuming to just a beach area? The gov. compensates the owner for what the beach?
I find it absurd how anyone can own a beach period, and I hope this comes as lessons learned for future NJS sales. What about the mean high tide line how does that come into play? The mean high tide line can be important in determining the boundary between a coastal private property and the public beach access way.
What about those who have signed the easements willingly, how does the emanate domain apply to them? Should they also be compensated? The cost could be astronomical.I agree the dunes need to be built, I am just not sure emanate domain is the solution, not to mention the lengthy and expensive legal process. Hopefully there is an easier path forward than this one!

ReplyI think it was so wonderful for Harry to tour the area, and I know for a fact that he did not jump over Ortley I saw the motorcade myself!
Thanks Harry for showing a little love to the NJS there certainly are enough haters who live here and a lot of them reside here in the patch blogs!! I would be ashamed as an American if any British citizen would see the total disgusting hateful comments here from locals.

ReplyI'm a primary owner in Ortley and while I feel the pain of the 2nd homeowner with not getting the same benfits as a tax payer as I did. Where do we draw the line? Does this mean millionares who can own multiple rental and personal properties would be eligible for FEMA benefits for each piece of property . How do you distinguish? What is fair and what becomes the raping of the "tax dollars". Tread lightly on this, if the 2nd, 3rd or however many property owners become eligibel where do you stop? It's a tough decesion but on the other hand 2nd homeowners pay taxes too. It's one of those things becarefull what you wish for kind of things!
