Poll: Should the U.S. Ban High-Capacity Ammo Magazines?

U.S. Sen. Frank Lautenberg will ask Congress to approve a ban on ammunition magazines of more than 10 rounds. Do you agree with his proposed bill?

 

In the wake of the mass shooting in Newtown, CT, U.S. Sen. Frank Lautenberg (D-NJ) announced plans to reintroduce high-capacity magazine ban legislation in the 113th Congress.

Lautenberg’s bill, the Large Capacity Ammunition Feeding Device Act, would prohibit the manufacture and sale of ammunition magazines with a capacity of more than 10 rounds. It also would ban ammunition magazines that could be readily converted to accept more than 10 rounds.

“In light of yet another horrific shooting tragedy, it is clearer than ever that there is no place in our communities for deadly high-capacity gun magazines and I will keep working to pass my bill to reinstate the ban on them,” Lautenberg said in a statement. “If we don't pass a high-capacity magazine ban this year, it will be the first bill I introduce when the new session of Congress begins in January.”

New Jersey’s senior senator cited the Newtown shootings—in which the gunman used a high-capacity rifle in his murderous spree, killing 20 children and seven adults—as reason for the reintroduction. But it goes beyond the Dec. 14 shootings to other mass killings in recent years, he added.

“These high-capacity magazines, which were used in Newtown, Aurora, Tucson, Virginia Tech, and so many other tragedies, were designed for one purpose only—to shoot and kill quickly,” Lautenberg said. “We must take immediate action to ban high-capacity gun magazines and assault weapons so that we can prevent the next massacre.”

Lautenberg introduced the same legislation in the current Congress. It stalled after getting referred to the Senate Judiciary Committee. A similar House of Representatives bill, sponsored by Rep. Carolyn McCarthy (D-NY), fizzled after getting referred to the House Subcommittee on Crime, Terrorism, and Homeland Security.

Sen. Dianne Feinstein (D-CA) also pledged immediate action in the 113th Congress, but her bill would go further in seeking to ban all assault weapons, plus high-capacity ammunition magazines.

Almost immediately after the Dec. 14 shootings in Newtown, public and online debate over gun control laws raged. Some posit the shooting rampage wouldn’t have been as deadly if the Sandy Hook Elementary School staff had firearms. Others decry laws that allow access to such high-powered weapons.

President Obama weighed in when he visited Newtown on Sunday, saying, “No single law—no set of laws can eliminate evil from the world, or prevent every senseless act of violence in our society. But that can’t be an excuse for inaction. Surely, we can do better than this.”

Devilsfan, as you are not familiar with weapons, high capacity: "...Depending on the locality and type of firearm, the cutoff between a 'normal' capacity and 'high' capacity magazine was 3, 7, 10, 12, 15, or 20 rounds. The now defunct federal ban set the limit at 10 rounds. ..."

Most liberals do not want to "ban guns", they want to contol who may receive weapons and what weapons.

[BTW, You are certainly allowed your opinion about abortions although there is absolutely no connection here and you are strangely attempting to insert a completely unrelated subject into a discussion of the Newtown massacre.]

SG you another know it all. I own several weapons including a Bushmaster so I am very familiar with magazines and I comply with the gun laws in NJ which limit magazine size to 10.

In regards to my correlation between the knee jerk/agenda ramming reaction from the left and banning guns "because of the kids" argument these same liberal support the daily killing of children called abortion. So why not ban abortions except for rape, incest & and medical reasons???????

It doesn't take high capacity magazines to kill people; multiple low capacity mags and someone who can reload fast can do the same damage. The same goes for low capacity mags and multiple guns. There are enough rules out there to prevent those who should not possess firearms from buying them, however, they will get them either way...stealing, borrowing, etc...

I still remember practicing changing clips...ejct the used clip, try not to fumble while getting the full clip off your holster, inserting it correctly and firmly into the weapon, first bullet into the chamber...

Banning guns or high capacity magazines with do nothing as is proven by the fact that these guns were not his, and the magazines were already illegal. Gun control will do nothing but take guns out of the hands of law abiding citizens. Address parenting issues, Mental Health issues, the fact that 20 years ago this didn't happen and guns were much easier to obtain. There are a host of issues causing this rise in gun violence, including violence on TV, video games, instant gratification, lack of parenting, the breakdown of family, failure to take responsibility for our actions, the blame society. You can go on and on, but banning guns will do nothing to stop another one of these incidents guaranteed.

Weren't these high-capacity clips already illegal?? There is no one single law that will solve this or prevent its occurrence in the future. I agree with the one post above that states we need to look at a much broader "treatment plan" to fix this epidemic.

Mental health issues ... Are we paying the price for de-emphasizing institutional care for decentralized treatment/control?

Violent movies and gaming ... You won't see any of the people making money off of these trying to tone down the desensitizing shock-value out in the market.

Gun control ... As soo as we figure out how to keep them away from the criminals and our own Federal Government stops seeding guns to criminals (Fast & Furious).

It's a shame we don't have a magic wand to wave over this problem to make it all better. But it's way more complicated than any single law could fix.

Every single victim of the recent Chinese knife attack survived. No one died. It is an excellent example of why America needs the broadest possible gun control that would still be consistent with the Second Amendment.

A definition of "assault rifle" is contained in the 1994 assault-weapons ban. It is not simple, and I won't cut-and-paste it here. However, it does limit certain semi-automatic rifles having at least some of a list of enumerated characteristics (e.g., pistol grip), as outlined in the law. It is sort of a "Chinese menu" definition. Part of the problem with the 1994 act was its complexity. A new assault-weapons ban should be simpler, broader and retroactive, reaching the greatest number of weapons and designs constitutionally permissible. In any event, any such ban should include most, if not all, AR-15s, the weapon used at Newtown and Aurora, et al.

The definition of a "high-capacity magazine" varies from state to state (most being greater than 10 rounds, some being much more), depending upon the adopted law. That is why the federal government should adopt a uniform law that preempts all such state laws. I would make it the smallest possible number (perhaps 10 rounds).

I am unaware of the specific number of defensive lives saved by a civilian gun owner. However, in the absence of credible evidence to the contrary, it is almost certainly far less than the people who die from the offensive and unilateral use of guns in domestic disputes and felonies.

He did this in the student center in front of students who had no time to act... horrific! and more examples in the papers and in the news every day from our cities and across the world... answers? not so easy... but we need to try!

Putting armed guards in schools is useless....By doing so you will drive the crazies elsewhere..You will have to put them at every major sporting event as well as malls and anyother gathering of the masses. Several suggestions were to end gun freezones.....Others have suggested arming the teachers....and several variations of the same ideas... other then locking up the screwballs I can see only one other solution...Everyone should have the right to carry a weapon after being trained and passing certain examinations .....mental and criminal background checks....seems all these idiots have illeagle guns and aren't going to comply with the law anyway so banning guns will only make honest law abiding people moving targets for the armed.

@Dan, do you even know what an automatic weapon is. Because if you did, you would know that it is already illegal to own an "automatic weapon" and has been for many many years. The shooter used a "semi auto" rifle which requires a pull of the trigger for each shot, just like every other gun in the world.

Dan, don't pay attention to these folks. Automatic weapons ARE now legal -- under certain defined circumstances -- but are highly regulated. They should be completely banned for all civilian use. And there is nothing saying that the Second Amendment protects civilian possession of those weapons, nor does the Second Amendment protect civilian ownership of all semi-automatic assault-style weapons, such as the AR-15 used at Newtown and Aurora.

Before we ban them - how about we find a way to track purchases. I really don't see a need for anyone to have an automatic weapon but if we have a federal database showing how many guns each person owns, how far apart they purchased each, and the amount of ammo they have been purchasing maybe red flags would have gone up and these individuals would have been stopped in their plans. Maybe in this case someone would have questions why a woman was stock piling guns, who else lived in the home with her and required a physco exam for it since it lived in a home with these weapons. Again just a maybe.
An all out ban scares me a little more - people would still get their hands on them. I want reform but I am not sure (even though I personally don't see a need) a ban would make a difference.
Our country has the tools - let's be proactive. BTW - they do need to change the law that allows you to buy guns at a gun show without a criminal background check immediately.

Jackie Everett: With all due respect and I sincerly mean this..Everyone who buys a legallly purchased gun in this country must have a criminal and mental background check. the reverse is a falacy...It's done instantly, it's called "NICS" over the phone abd costs the buyer $15.00 to $25.00. To not do so is an illeagle purchase and considered a felony....Purchases are tracked and recorded in NJ as well as most if not all other states.

A novel idea would be to find all those weapons Ba rack and his bud E ric doled out in their Fast and Furious operation. I suggest you libs research that a bit. The Gov t run media has neglected to inform you of it. Brian Terry, US Border Patrol Agent was assassinated with one of the weapons that they were handing out to the drug cartels w/out tracking them. All in an effort,in what appears to be a strategy to get weapons out there causing havoc and then influencing public opinion to BAN THEM. Sound familiar?? Will we ever find out what really happened in CT?? Most likely not.

UMMMMM JOE R....Machine guns may be purchased and sold legally in the United Staes.....You need a class "C" license which is obtainable from the Federal government in conjunction with the State you live in......By the way, in some States you may purchase hand grenades for immediate use on a designated range designed for that purpose.... If you would like to fire a machine gun just for the fun of it...and it is fun....Go to Nevada, Harry reid got the range license passed

UMMMMMMMMMMMMMMMM NJ ghost do you think it is an easy process to purchase a machine gun????? You have to go through an FBI check and screening for openers. OK, let's do the same for semi-automatics. Great, let's require buyers of semi-automatics to go through the same background check that you have to go through to purchase a machine gun.
